TERMS OF SERVICE (Enrollment Agreement)

By submitting payment information, attending lessons, or permitting a student to attend lessons, you agree to be bound by these Terms of Service.


1. TUITION & BILLING

Tuition is billed monthly at a flat rate and does not vary based on the number of lessons in a given month. Tuition is typically charged on the 1st of each month. If you enroll mid-month, or participate in a special promotional offer, you may be charged separately for your initial or partial-month lessons before recurring monthly billing begins. You authorize tuition to be automatically charged to the payment method saved on file. If a payment is declined or returned for any reason, a $25 failed payment fee will be applied, and lessons may be suspended until the account is brought current. Tuition is prepaid and nonrefundable.

2. CANCELLATION & MAKEUP POLICY

If a student must miss a lesson, at least 24 hours’ notice is required to be eligible for a makeup lesson. Makeup lessons must be scheduled during the teacher’s available teaching hours and are subject to availability. Makeup lessons and cancellations should be arranged directly with the teacher by text (not verbally) to ensure a clear record. If concerns arise, the Academy director may be contacted. Same-day cancellations and no-shows will not be eligible for makeup lessons. In the event a teacher must cancel, Brenham Music Academy will offer a makeup lesson during the teacher’s available teaching hours. Credits or refunds are not issued for missed lessons, except in rare cases at the Academy’s discretion. Make-up lessons are not provided for scheduled holiday breaks.

3. HOLIDAYS & LESSONS PER MONTH

Tuition is billed monthly and remains the same regardless of the number of lessons in a given month. Some months will include 5 lessons when the calendar has five of the same weekday. Some months may include only 3 lessons because of holidays. These variations generally balance out over the course of the year, so students receive roughly the same number of lessons overall. Tuition is not adjusted for months with fewer lessons. Make-up lessons are not provided for scheduled holiday breaks. Brenham Music Academy observes the following scheduled breaks, during which no lessons will be held:

  • Labor Day
  • Thanksgiving Break – Tuesday-Friday
  • Christmas Break – 1 week
  • New Year’s Break – 1 week
  • Spring Break – 1 week
  • Memorial Day
  • July 4th Weekend

4. WITHDRAWAL POLICY

You may withdraw at any time by providing written notice by email to brenhammusicacademy@gmail.com or by text to 979-421-9898. Notice must be received at least 7 days before the 1st of the month in order to avoid charges for the upcoming month’s tuition. For text withdrawals, delivery must be confirmed by the Academy in order to be effective. Verbal withdrawals made in person will not be accepted. If you withdraw after the 1st, any remaining lessons that month may still be attended but will not be refunded.

5. INCLEMENT WEATHER & EMERGENCIES

In the event that lessons are cancelled due to inclement weather or other emergencies, the Academy may, at its discretion, continue lessons online or offer makeup lessons. Makeup lessons for weather-related closures are not guaranteed. Tuition is not refunded or credited for weather-related closures. If the Academy remains open, but a student chooses not to attend due to weather, that absence is treated as a regular cancellation. You are responsible for your own judgment regarding travel to and from lessons during inclement weather.

6. ADDITIONAL COSTS

Tuition covers weekly private lessons only. Instructional books, sheet music, instruments, and related supplies are the responsibility of the student and are not included in tuition. Participation in special programs — such as recitals, solo festivals, theory tests, or ensemble events — may require an additional fee.

7. TUITION CHANGES

Brenham Music Academy may adjust tuition rates and fees at any time. Notice of tuition changes will be provided by email to you before the new rates take effect. Continued payment of tuition or attendance at lessons after the effective date constitutes acceptance of the updated rates.

8. POLICY CHANGES

Brenham Music Academy may update these Terms of Service at any time. Material changes will be communicated to you by email before they take effect. Non-material changes will be posted with an updated “Last Updated” date. Continued payment of tuition or attendance at lessons after the effective date constitutes acceptance of the updated terms.

9. MEDIA RELEASE

Brenham Music Academy loves to celebrate our students’ progress and milestones. We occasionally take photos or short videos during lessons, recitals, and events to share with families and to highlight student achievements. These may also be used for educational and promotional purposes, such as on our website, social media, or printed materials. You grant, to the extent of your authority, permission for the Academy to use the student’s likeness in such media, including group and individual photos or videos, even if the student is no longer enrolled. The Academy is not responsible for unauthorized use or distribution of media by third parties.

10. RIGHT TO TERMINATE

Brenham Music Academy reserves the right to terminate services at any time, at the Academy’s sole discretion. Reasons for termination may include, but are not limited to: failure to maintain payment, repeated absences or no-shows, or disruptive or disrespectful behavior by the student or parent.

11. LIABILITY WAIVER

You agree to release, indemnify, and hold harmless Brenham Music Academy, its teachers, staff, agents, and affiliates from any and all claims, liabilities, or damages arising from participation in lessons, events, Academy activities, or use of Academy facilities, except in cases of intentional misconduct or gross negligence.

12. GOVERNING LAW & VENUE

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under them shall be resolved exclusively in the courts located in Washington County, Texas.
